Terms of Service

By accessing or using the OFACScreen platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

OFACScreen provides a web-based platform and API for screening individuals and entities against global sanctions lists, including but not limited to OFAC SDN, OFAC Non-SDN, BIS, and other government-maintained sanctions lists. The Service includes:

• Real-time name and entity search against consolidated sanctions data
• Batch screening via CSV upload
• REST API for programmatic access
• Audit logging and reporting
• Hourly data updates from government sources

The Service is offered under paid subscription plans with varying levels of access and usage limits. A free trial period may be offered at our discretion. Details of current plans and pricing are available on our pricing page.

Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are provided.

We reserve the right to change pricing with 30 days notice. Price changes will take effect at your next renewal date.

OFACScreen aggregates data from publicly available government sanctions lists. While we make every effort to ensure the accuracy and timeliness of this data, we do not guarantee that the data is complete, current, or error-free.

The Service is intended as a screening tool to assist with your compliance obligations. It does not constitute legal advice and should not be relied upon as the sole basis for compliance decisions. You are responsible for conducting appropriate due diligence and consulting qualified legal and compliance professionals.

We are not responsible for any actions taken or not taken based on the results provided by the Service. Screening results should be independently verified before making business decisions.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell or redistribute the Service or its data without authorization
• Exceed the usage limits of your subscription plan through automated means
• Interfere with or disrupt the integrity or performance of the Service

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFACSCREEN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or if required by law. You may terminate your account at any time by contacting us or through your account settings.

Upon termination, your right to access the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
